Content Analysis of Judges' Sentiments Toward Artificial Intelligence Risk Assessment Tools

Artificial intelligence (AI) uses computer programming to make predictions (e.g., bail decisions) and has the potential benefit justice system save time reduce bias). This secondary data analysis assessed 381 judges’ responses question, “Do you feel that artificial (using programs algorithms) holds promise remove bias from sentencing decisions?” The authors created apriori themes based on literature, which included algorithm aversion appreciation, locus of control, procedural justice, legitimacy. Results suggest judges experience aversion, have significant concerns about being exacerbated by AI, worry replaced computers. Judges believe AI inform their decisions sentencing; however, it must be empirically tested follow guidelines. Using gathered sentiments toward we discuss integration into legal future research.
